the republicans did this to john kerry in 2004. they tried to take his greatest biographical asset away from him, having volunteered for combat in vietnam. having been wounded in vietnam. having been awarded medals for valor, medals for his heroism in combat. they lied about him and some people, we don't know how many, but some people believed the lies about john kerry. and the morning after the 2004 election, when the final, very narrow margin of victory was calculated in the state of ohio, john kerry had to concede that presidential election and in effect is a former campaign operative. he and his anti-obama video have been praised by karl rove on twitter. we know what the republicans have learned about swiftboating. you can get away with a lie to some of the people, some of the time, and that just might be enough people to win you a presidential election, if they live in ohio. and now, the swiftboating of barack obama has begun and we're about to discover what the democrats have learn since john kerry had to concede to a lie. du

senator john kerry, again a gentleman that i've worked with, have a lot of respect for, referred to recess appointments as an abuse of power of the presidency. sometimes in this business there's a certain amount of political push and shove that goes on, obviously. i don't think that's what they were talking about here. i think they were talking about genuine issues of constitutional power. now, in your case, if we accept the premise of your validity in this position, then we accept the premise that our ability to offer advice and consent basically disappears. because the president can determine when we're in recess and when we're not in recess. and just appoint whoever. and then we don't have a constitutional provision for advice and consent of the senate. now i've been through that process. i have a tremendous amount of respect for that process. i think i benefited greatly and i hope the country benefited greatly from me going through that process and seeking a vote in the senate. and i had no idea when i started it whether i would win or lose. now there's even a greater challenge here. w
